These Terms of Service (the "Terms") govern your access to and use of the Hookology platform, websites, APIs and related services (the "Service") provided by Hookology Ltd ("Hookology", "we", "us", or "our"). By creating an account or using the Service, you agree to these Terms.
You must be at least 16 years old and able to form a binding contract to use the Service. You are responsible for the accuracy of the information you provide, for safeguarding your credentials, and for all activity that occurs under your account.
The Service is organised into workspaces. The person who creates a workspace is its owner and may invite members and assign roles. Workspace owners are responsible for ensuring that all members comply with these Terms and that the workspace has the rights to all data connected to it.
You retain ownership of all data you upload or connect to the Service ("Customer Data"), including advertising, commerce, and analytics data pulled via integrations such as Meta Ads, Google Ads, TikTok Ads, Shopify and similar providers. You grant Hookology a worldwide, non-exclusive, royalty-free licence to host, process, analyse and display Customer Data solely to operate and improve the Service for you.
You represent that you have the rights and authorisations to connect any third-party accounts and to allow Hookology to access them. You are responsible for complying with the terms of those third parties.
The Service includes AI-powered features such as creative tagging, forecasting, recommendations, and generated text. Outputs are produced by statistical models and may be inaccurate or incomplete. You are responsible for reviewing AI outputs before acting on them, and you must not rely on them as professional, legal, financial, or medical advice.

Paid plans are billed in advance on a monthly or annual basis using the plan and currency shown at checkout. Fees are non-refundable except where required by law. We may change pricing with at least 30 days' notice; changes take effect at your next renewal. Failure to pay may result in suspension or termination of the Service.
We may offer free trials or beta features at our discretion. Beta features are provided "as is", may be changed or discontinued at any time, and may have additional terms presented at the time of use.
We strive to keep the Service available and performant but do not guarantee uninterrupted access. Planned maintenance, third-party outages, and force majeure events may affect availability.
The Service, including its software, designs, branding, and content (excluding Customer Data), is owned by Hookology and protected by intellectual property laws. We grant you a limited, revocable, non-transferable licence to use the Service for your internal business purposes during your subscription.
We may use aggregated, de-identified data derived from the Service to improve our products and to publish benchmarks, provided no individual workspace, user, or customer can be identified.
Each party agrees to protect the other's confidential information using at least the same care it uses for its own confidential information, and to use it only to perform under these Terms.
You may cancel your subscription at any time from your account settings; access continues until the end of the current billing period. We may suspend or terminate your access immediately if you materially breach these Terms, fail to pay, or pose a security or legal risk. On termination, we will delete or return Customer Data on request, subject to legal retention requirements.
To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be error-free, uninterrupted, or that AI outputs will be accurate.
To the maximum extent permitted by law, neither party will be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill. Hookology's total aggregate liability arising out of or related to these Terms will not exceed the amount you paid to Hookology in the twelve (12) months preceding the event giving rise to the claim.
You agree to defend, indemnify and hold harmless Hookology from and against any claims, damages, liabilities and expenses arising out of your Customer Data, your use of the Service in breach of these Terms, or your violation of any law or third-party right.
We may modify the Service or these Terms from time to time. If we make material changes, we will give you reasonable notice (for example, by email or in-app). Continued use of the Service after the changes take effect constitutes acceptance.
These Terms are governed by the laws of England and Wales, without regard to conflict-of-law principles. The courts of England and Wales have exclusive jurisdiction over any dispute arising out of or in connection with these Terms, except where mandatory consumer protection laws of your country of residence apply.
